A DUI conviction has serious consequences, even when it is just your first conviction. If you are found guilty a second or third time, the punishment becomes correspondingly more severe. In fact, if committed within seven years of the original charge, a third offense can be considered a felony DUI.
A first-time non-extreme DUI charge is punishable by at least a day in jail, more than $1,250 in fines, a 90-day license suspension, and installation of an ignition interlock device. But a second conviction is punishable by at least 30 days in jail, more than $1,700 in fines, a one-year suspension of your license, and an ignition interlock device.
Having a blood alcohol concentration (BAC) of .15% or greater can result in at least 30 days in jail, more than $2,000 in fines, a 90-day license suspension, and an ignition interlock device. These penalties are more severe in the event of a second extreme DUI conviction: at least 120 days in jail, more than $3,000 in fines, a one-year license suspension, and an ignition interlock device.
If you are cited with a BAC of .20% or greater, it can result in at least 45 days in jail, more than $6,000 in fines, a 90-day license suspension, and an ignition interlock device. However, a second super extreme DUI can result in at least 180 days in jail, more than $17,000 in fines, a one-year license suspension, and an ignition interlock device.
If you are charged with a third DUI within 7 years, or charged with a DUI while driving with a suspended license, it can result in a felony DUI charge, or aggravated DUI. This is punishable by at least 4 months in prison, more than $150,000 in fines, a three-year license suspension, and an ignition interlock device.
